The way I see the situation, Judge McGuire is way off base on several counts… by interjecting the legally irrelevant issue of same-sex marriage, while failing to take into account existing laws that are LGBTQ “blind”, so to speak.
1) On the federal level; the 2015 Supreme Court case Pavan v. Smith found that it was unconstitutional to treat queer couples differently than heterosexual couples in presuming parentage. If married heteros are presumed to be parents of children born during their marriage, the same must be true for LGBTQ+ couples.
2) On the state level; Same-sex marriage and adoption have been legal since 2014 when a U.S. District Court for Oklahoma ruled the state’s ban on same-sex marriage, and any "legal incidents thereof conferred upon unmarried couples or groups," as unconstitutional. Following that decision, supported by the Tenth Circuit Court and SCOTUS, Oklahoma began allowing same-sex marriages.
3) Also on the state level; Oklahoma Statute, Title 10. Children, §10-552. Status of child, states, “Any child born as the result [of ***** donation] shall be considered at law in all respects the same as a naturally conceived legitimate child of the husband and wife.”
Williams’ attorney, Robyn Hopkins, explained it best; “Kris is on the birth certificate of this child and they were married,” further clarifying, “They were married. Marriage is legal. Same sex marriage is legal in the state of Oklahoma. And they had a child. So, there’s a child of the marriage!”
